Payment terms
Femmecare general payment terms
These payment terms apply to all invoices that Femmecare Clinics B.V. (hereinafter: Femmecare) sends to patients for care provided by Femmecare, and for services connected with it. This English version is provided purely as a courtesy. The Dutch version is the only binding text: in the event of any difference, the Dutch text applies.
In brief
- You receive the invoice yourself and submit it to your health insurer.
- Dutch health insurance? Then you are insured for our care, and you pay only after you have received the reimbursement from your health insurer.
- Goodwill is settled before you pay. It is a gesture, not an entitlement.
- Goodwill lapses 30 days after the invoice date. So submit the invoice as soon as you receive it.
- The own risk is never covered by the goodwill arrangement.
- Cancelling an appointment: at least 24 hours in advance (on working days), otherwise we may charge a no-show fee.
1Treatment agreement
By entering into a treatment relationship with Femmecare, a treatment agreement is concluded between the patient and Femmecare, as referred to in Article 7:446 of the Dutch Civil Code (WGBO). Under this agreement the patient is obliged to pay the costs of the care provided by Femmecare. See also our treatment agreement.
2Rates and invoicing
Femmecare invoices the costs of the care provided directly to the patient. Invoicing is based on the applicable rates for medical specialist care. The patient receives an itemised invoice stating at least the care provided, the date of care, the invoice amount and the payment period.
3Non-contracted care
Femmecare does not (yet) have contracts with health insurers. Femmecare therefore provides non-contracted, but insured, care. This means that Femmecare invoices the costs of the care provided directly to the patient.
Patients with Dutch health insurance are always insured for care provided by Femmecare. The patient submits the invoice to his or her health insurer. Depending on the policy conditions, the health insurer reimburses the invoice amount in full or in part.
Any reimbursement by the health insurer is a matter between the patient and his or her health insurer and does not affect the patient’s payment obligation towards Femmecare.
4Own risk and personal contribution
If the care falls under basic health insurance, the reimbursement by the health insurer may be set off in full or in part against the statutory own risk or any personal contribution. These amounts remain payable by the patient, except where the goodwill arrangement in Article 10 is applied.
5Responsibility for payment
The patient remains fully and unconditionally responsible at all times for payment of the invoice to Femmecare, regardless of:
- the extent or amount of reimbursement by the health insurer;
- whether the own risk applies;
- the policy conditions of the health insurer.
6Payment period
Invoices must be paid within 14 days of the invoice date, unless stated otherwise on the invoice.
Payment must be made by transfer to the bank account stated by Femmecare, quoting the invoice number. Payment must be made without suspension, discount or set-off, unless mandatory law provides otherwise or the goodwill arrangement in Article 10 is applied.
7Late payment
If the patient does not pay the invoice within the stated payment period, the patient is in default by operation of law. In that case Femmecare is entitled:
- to charge statutory interest;
- to charge extrajudicial collection costs in accordance with the Dutch Extrajudicial Collection Costs (Standardisation) Act (WIK).
If payment is still not made after a reminder, Femmecare may pass the claim to a debt collection agency (in our case Medicas Incassojuristen). The costs involved are, as far as legally permitted, payable by the patient. When the claim is passed to Medicas, the payment terms of Medicas.
8Disputing invoices
If the patient believes that an invoice is incorrect, this must be notified to Femmecare in writing within 14 days of the invoice date, via rekenkamer@femmecare.nl. A dispute suspends the payment obligation only for the disputed part of the invoice.
9Payment arrangements
Femmecare may, entirely at its own discretion and without being obliged to do so, agree a payment arrangement. No rights can be derived from such an arrangement for future invoices or situations.
10Goodwill arrangement
10.1 Nature of the arrangement
Femmecare may in individual cases decide to waive (part of) a claim in whole or in part, or to apply a goodwill arrangement. The goodwill arrangement is a voluntary contribution by Femmecare and is a gesture, not an entitlement. Femmecare assesses for each patient and each treatment whether a contribution is possible. The arrangement is expressly not a standard discount and is not applied automatically. No rights can be derived from the arrangement, from an earlier award of it, or from any communication about it. Femmecare is entitled to amend, limit or end the arrangement.
10.2 Scope
The goodwill arrangement covers only the part of the invoice amount that is not reimbursed by the patient’s health insurer. Excluded from the goodwill arrangement are in any event:
- the statutory and the voluntarily chosen own risk;
- costs for uninsured care and the self-pay rate;
- the no-show fee referred to in Article 13;
- interest, collection and extrajudicial costs referred to in Article 7.
The arrangement applies only to patients with Dutch health insurance. Patients with insurance from outside the Netherlands are responsible for their own claim; the goodwill arrangement does not apply to them. Budget policies may be excluded from the arrangement.
10.3 Conditions
A request for goodwill is only eligible for assessment if all of the conditions below are met:
- the patient has submitted Femmecare’s invoice to his or her health insurer in good time, and as soon as possible after receiving it;
- the patient has approached Femmecare directly about this; a request cannot be made through the invoice itself;
- the complete request has been received by Femmecare within 30 days of the invoice date.
A request is complete if Femmecare has: (i) the invoice number, (ii) the health insurer’s claim statement showing the reimbursement awarded and the own risk set off, and (iii) an explicit request from the patient to apply the goodwill arrangement. An incomplete request does not count as a request within the meaning of this Article.
10.4 Lapse period
30 daysafter the invoice date
The option to request goodwill lapses 30 days after the invoice date. After that, goodwill can no longer be requested, assessed or awarded. This expressly also applies to invoices the patient has already paid: the administrative period concerned has then been closed in Femmecare’s accounts.
No exceptions can be made to this lapse period. It is the patient’s responsibility to submit the invoice to the health insurer immediately after receiving it and to provide the request in good time and in full.
10.5 Implementation
Femmecare assesses a complete request before the patient pays. If goodwill is awarded, it is set off against the amount the patient must pay Femmecare. In that case the patient pays the amount reimbursed by the health insurer and, where applicable, the own risk set off. If the request is refused, the full invoice amount remains payable.
11Minors
If the patient is a minor, the treatment agreement is deemed to have been entered into by the legal representative(s). The legal representative(s) are jointly and severally liable for payment of all costs arising from the treatment agreement.
12Personal and insurance details
The patient is responsible for providing correct personal details and, where applicable, insurance details, in good time and accurately. If incorrect or incomplete details are provided, the resulting costs are payable by the patient.
13Cancellation and no-show
If a patient cannot keep an appointment, it must be cancelled or rescheduled at least 24 hours (on working days) before the scheduled time.
If an appointment is not cancelled in time, or if the patient does not attend without notice (no-show), Femmecare is entitled to charge a no-show fee for the time and capacity reserved. This fee is not a care service and is not reimbursed by the health insurer.
The amount of the no-show fee is stated in the uninsured care table on our page self-pay rates. In exceptional cases, entirely at its own discretion, Femmecare may decide not to charge this fee.
14Governing law
These payment terms and all legal relationships between Femmecare and the patient are governed by Dutch law.
